Court to hear Susno’s pre-trial lawsuit Monday

The South Jakarta District Court first start hearing on Monday a pre-trial lawsuit filed by former police’s chief detective Comr. Gen. Susno Duadji against his own corps over his arrest.

Susno’s layer Mohammad Assegaf insisted on Saturday his client’s arrest breached the procedure and lacked evidence.

Police investigators are incarcerating Susno at the Mobile Brigade detention center in Kelapa Dua, in the West Java city of Depok, immediately after naming him a suspect two weeks ago for allegedly receiving Rp 500 million (US$54,000) in bribes from suspected case broker Sjahril Djohan.

Sjahril, also a suspect in the case, testified to detectives that he had handed over the cash at Susno’s house in Cinere, Depok, West Java, according to a leaked police document.

The bribery was allegedly linked with a police investigation into a deception case involving a Riau-based arowana fish farming company during Susno’s tenure as the National Police chief detective.

Justice and Human Rights Minister Patrialis Akbar said he appreciated the National Police’s attempt in eradicating terrorism, but said it would be better if the suspects were captured alive rather than shot dead at the site.

“I think, concerning the law and human rights, I really hoped they would be arrested alive,” Patrialis said Wednesday as quoted by kompas.com.

The National Police have conducted raids in Sumatra and Java since February, detaining 58 suspects while 13 others, including Southeast Asia’s most wanted terror suspect, Dulmatin, were shot dead.

Detachment 88 antiterror squad have reasoned that those killed were all attempting to resist arrest.
Patrialis said he had talked with the National Police chief Gen. Bambang Hendarso Danuri, who  guaranteed that the raids and arrests had complied with regulations.

However, Patrialis said terrorists caught alive would be more valuable to the antiterror effort.

The House of Representatives’ Bank Century case monitoring committee decided to postpone its hearing with National Police chief Gen. Bambang Hendarso Danuri after finding him using a wrong reference.

When explaining the House’s recommendation concerning the Bank Century bailout, Bambang was referring to the option that was voted out during a plenary House meeting to respond to an inquiry into the controversial decision to salvage the bank.

The House declared the bailout and acquisition process which led to formation of Bank Century flawed. But in Bambang’s introductory statement, he said the process was in line with the law.

It turned out later during the hearing that the police chief had not received the documents on the House’s recommendation.

After a lengthy debate among the House politicians, committee chairman Priyo Budi Santoso decided to delay the hearing until the police chief obtained the right documentation.

Bambang said he would only be available after May 28, when he arrived home from an overseas trip to Cambodia.

The committee postponed a hearing with the Corruption Eradication Commission last week as the antigraft commissioners had not received any documentation related to the House’s inquiry into the bailout.
